TITLE Introduction to Tax Administration and the Public Sector

DESCRIPTION This study-unit will address the following topics:

Unit 1 – Overview of the Maltese tax regulatory framework:
- Describe the history of the Maltese taxation system
- Describe direct and indirect taxes
- Classify progressive, regressive and proportional taxes
- Explain the distinction between employment and self-employment.

Unit 2 – Jurisdiction to Tax in Malta

Unit 3 – Classification of Taxable Income in Malta

Unit 4 – Taxation of Employment Income:
- Calculate the employment income of an individual, dealing correctly with fringe benefits
- Prepare the income tax computation of an employee
- Calculate the National Insurance Contributions payable in relation to an employee
- Describe the Final Settlement System (Social Security Payments).

Unit 5 – Taxation of Corporate Entities;
- Identify tax-efficient ways of relieving a company’s trading losses and non-trading losses
- Identify deductions, exemptions, capital allowances etc.

Unit 6 – Taxation of Capital Gains;
- Overview of salient features of Capital gains taxes in Malta

Unit 7 – Duty on Documents and Transfers Act:
- Overview of the salient features of Duty on Documents and Transfers Act

Unit 8 – Tax Administration:
- State the due dates for payment of tax for a company and explain the operation of provisional tax
- Analysis of rights of tax authorities and penalties imposed for non-compliance.

Unit 9 – VAT System:
- A review of the VAT system, and compliance matters related thereto.

Unit 10 – Anti-Avoidance Measures;
- Identify the difference between tax avoidance and tax evasion and explain the current view of the courts with regard to tax avoidance schemes.

Study-unit Aims:

The aim of this study-unit is to provide students reading for the BA (Hons) Public Sector Accounting with knowledge of basic tax principles and the applicable legislation, with particular reference to the Public Sector.

Learning Outcomes:

1. Knowledge & Understanding
By the end of the study-unit the student will be able to:

- Explain the history and functions of taxation and identify alternatives to the current taxation system;
- Explain the principles of value added tax and apply these principles to public sector organisations.

2. Skills
By the end of the study-unit the student will be able to:

- Calculate the income tax and National Insurance contributions payable in relation to an employee working in the public sector;
- Determine the tax liability of a trading company operated by a public sector organisation.
