DESCRIPTION This study-unit studies criminal procedure, namely articles 346 to 619 of the Criminal Code. These deals with the powers of the Police, the Courts of Magistrates, jurors, the Attorney General, Defence Counsel and certain special proceedings such as the granting of bail, the bill of indictment, etc. Students will be taught the laws and case law relevant to the subject of this study-unit.

Study-unit Aims:

The aim of this study-unit is to equip the student with the necessary knowledge of the composition, jurisdiction and structure of the courts of justice of criminal jurisdiction. It will focus on the structure of the Courts of Justice of criminal jurisdiction; the Court of Magistrates, the Criminal Court, the Court of Criminal Appeal, the officers of these courts, police powers, the granting of bail, the bill of indictment, jury trials and inquiries by Inquiring Magistrates.

Learning Outcomes:

1. Knowledge & Understanding:
By the end of the study-unit the student will be able to:

(a) understand the court structure and the interaction between all the different criminal courts;
(b) know what are the duties of the various court officers within the administration of justice;
(c) comprehend the jurisdiction of each court of justice of civil jurisdiction;
(d) know what powers the police are granted by law;
(e) comprehend how certain institutes of criminal procedure (bail, bill of indictment, trials by jury) function.

2. Skills:
By the end of the study-unit the student will be able to:

(a) identify the court structure by setting out the functions and composition of each court of criminal jurisdiction;
(b) comment upon the duties carried out by all court officers;
(c) interpret the rules regulating the jurisdiction which is exercised by all the courts of justice of criminal jurisdiction;
(d) analyse police powers;
(e) write on certain special criminal proceedings studied in this study-unit.
