| DESCRIPTION | The study-unit aims to provide an explanation and understanding of: - The Notion of Ownership under Maltese law; - The Fundamental Right to Own Land and the Right of Peaceful Possession; - Exceptions and Qualifications to this Right; - Modes of Acquisition, Transmitting and Termination of Ownership; - Privileges and Hypothecs and their effect on owners and third parties; - Procedures associated with Ownership: Land registration, prescription, separation of estates. The study-unit will also focus on the legal aspects relating to the most important areas of Property law with respect to Estate Management: (a) Legal Title over Property; (b) Expropriation. Study-Unit Aims: The aim of this study-unit is to acquaint students who do not have a legal background with the sources of Maltese law that regulate property law as applicable in the field of estate management. Students will also be introduced to case law on the subject and required to delve into particular case studies. Learning Outcomes: 1. Knowledge & Understanding: By the end of the study-unit the student will be able to: - possess a good grasp of the basic legal principles relating to the Law of Property as they emerge from the various sources of Maltese law; - become conversant and be able to apply legal terms and legal procedures relating to the Law of Property and the general position of the law in this respect; - identify who are the relevant parties involved in property transactions and which are the institutions that regulate property law. 2. Skills: By the end of the study-unit the student will be able to: - apply legal obligations and titles to the understanding of land use and land management; - choose the necessary procedures and identify the authorities responsible for their implementation; - evaluate the risks and burdens involved as a result of these legal obligations imposed by Ownership law and Property law when projecting land management.
