DESCRIPTION | This study-unit provides students with the tools necessary to understand the mode of procedure in contentious matters. In particular they will learn about the procedures before the Court of Magistrates and the Civil Court, First Hall and the Court of Appeal. The procedures in question will study how court cases are instituted; how appeals are filed from judgments of lower courts to higher courts; how judgments are enforced; how executive acts are implemented. Students will be taught the laws and case law relevant to the subject of this study-unit. Study-unit Aims: The aim of this study-unit is to equip the student with the necessary knowledge of the mode of procedure in contentious matters. It will focus on articles 98 to 469 of the Code of Organization and Civil Procedure. These deal with: applications, trial of causes, decrees, judgments, appeals, executive titles and certain special proceedings. Learning Outcomes: 1. Knowledge & Understanding: By the end of the study-unit the student will be able to: (a) understand the mode of procedure before the various courts; (b) know what are the differences in procedure between the ordinary and the special modes of procedure; (c) comprehend the nature of judgments and decrees. 2. Skills: By the end of the study-unit the student will be able to: (a) identify the rules regulating the mode of procedure in contentious matters; (b) distinguish between ordinary and special court proceedings; (c) comment upon the differences that exist in enforcing executive titles.
