TITLE Legal Framework on Migration for Cultural Mediators

DESCRIPTION This study-unit will give an overview of the legal and policy framework that regulates migration in its broadest form. It will also seek to examine the institutional structures that are most relevant in this field. Cultural Mediators are directly involved in the facilitation of relations between newcomers and Malta, as a host country and key to their role is a basic understanding of the institutions relevant to migrants, amongst them the Courts, the Office of the Refugee Commissioner, Identity Malta.

The Study-unit will cover the following topics:

- Introduction & Expectations;
- International and European Legal FrameworksMalta as a Nation;
- the 1964 Constitution;
- Parliament, Courts and Tribunals;
- National Legal Context;
- law-making & relevant legal framework;
- Institutions:
    - State: Refcom, Identity Malta, AWAS ,RAB & IAB & Other complaints systems & Equality Bodies; Institutions
    - Non-State: UNCHR, IOM, NGOs; Forced Migration I
- reception, age assessment and vulnerability, statuses;
- Forced Migration II - the asylum procedure, Dublin, returns/non-returns; Voluntary Migration - Residence Permits, Specific Residence Authorisation, Free movement rights; Detention and means of redress;
- Criminal Justice - Court, Juvenile, Legal aid, Stakeholders; Citizenship, Long-Term Residence, Family Reunification; Anti-discrimination, hate speech and hate crime

Study-Unit Aims:

- To equip the student with an understanding of how the legal and institutional frameworks are set-up;
- To give the student a basic background on different migrants and their associated rights;
- To prepare students on how to assist a client through legal processes that may arise.

Learning Outcomes:

1. Knowledge & Understanding:

By the end of the study-unit the student will be able to:

- Recognise differences between specific migrants and the basic implications of their particular immigration status;
- Identify the relevant institutions and their role in migrants' lives;
- Recall the most prevalent legal issues that may arise in a migrant's life.

2. Skills:

By the end of the study-unit the student will be able to:

- Identify where to direct the migrant for the correct information;
- Explain key concepts to migrants during their dealings with authorities, departments and/or their legal advisors;
- Analyse a legal issue and seek advise from identifiable actors in the migration field.
