DESCRIPTION The aim of this study-unit is to provide participants with an introductory background of developments, as well as a knowledge of various aspects of labour law in the European Union. Particular attention will be paid to directives and measures adopted by the European Union on the subject. Reference will also be made to important judgments delivered by the European Court of Justice. The study-unit focuses on the following issues: Introduction and Historical Context; The Free Movement of Workers; The Contract of Employment (Working Time Directive, Part-Time Work, Fixed-Term Agreements, Parental Leave); Employment Protection (Collective Redundancies, Transfers of Undertakings, Insolvency); Collective Bargaining and the Framework Agreements (requisites of European collective bargaining, representativity, implementation of these agreements); Gender Equality and The Working Environment (Health and Safety Issues).

Study-unit Aims

To introduce students to the EU labour and social policy;
To analyze the various legal instruments dealing with labour law and to study the objectives behind such policies.

Learning Outcomes

1. Knowledge & Understanding:
By the end of the study-unit the student will be able to:

a) critically analyze contemporary employment law issues;
b) analyse the legal basis in the Treaties, the secondary legal instruments and the relevant case-law re EU Labour law;
c) interpret new and existing EU legislation and case-law;
d) prepare reports and illustrate issues about a particular given legal position in EU law;
e) plead EU Labour law issues in a court of law.

2. Skills:
By the end of the study-unit the student will be able to:

a) demonstrate knowledge on EU Labour law to enable them to practice in the field and to undertake more specialized courses.
