DESCRIPTION The study-unit will consist of an introductory course on the elements of Articles 101 and 102 TFEU by reference to the European Commission's decisional practice and the jurisprudence of the CJEU. Reference will also be made to related EU secondary legislation and Commission guidelines. The procedures involved in the enforcement of Articles 101 and 102 of the TFEU will also be discussed.
Study-unit Aims:

- To provide students with an understanding of the legal and economic principles underlying the EU substantive competition rules;
- To provide students with an insight into the European Commission's and CJEU's thinking and approach on collusive and cooperative conduct among market players and abusive conduct by dominant undertakings;
- To provide students with an understanding of the procedures and rules relating to public and private enforcement and the consequences that could follow where anti-competitive conduct is found.

Learning Outcomes:

1. Knowledge & Understanding
By the end of the study-unit the student will be able to:

- Interpret and apply Article 101 TFEU distinguishing between those agreements which are harmful to the competitive process and those which have beneficial effects or otherwise fall outside Article 101(1);
- Interpret and apply Article 102 TFEU by defining the relevant market, establishing dominance and identifying abusive conduct;
- Understand the public enforcement of the competition rules after examining the investigatory powers and the decision-making role (including the fining policy) of the European Commission;
- Understand the private enforcement of the competition rules before the national courts.

2. Skills
By the end of the study-unit the student will be able to:

- Understand EU competition policy and law;
- Analyse market conduct from a competition law perspective and determine how the competition rules apply to a particular set of facts;
- Critically examine the approach of the European Commission and the CJEU in competition cases.

Students are required to register for Level 1 Units if they are in Year 1, for Level 2 Units if they are in Year 2, and for Level 3 Units if they are in Year 3 or 4 of their course.
