DESCRIPTION This study-unit traces the historical evolution of Criminal Law and Procedure in Malta. It studies the various drafts of the Criminal Code, the reports written thereupon in particular that of Andrew Jameson, the discussions and adoption of the Code in the Council of Government as well as subsequent changes made to the Code since its promulgation in 1855 to date.

Study-Unit Aims:

This study-unit aims to delve deeper into the historical development of the Criminal Code by going through the various reports that lead to the codification of the Criminal Code, the drafts of the Criminal Code, its passage in the Council of Government, the contribution of Andrew Jameson and how the Criminal Code has developed from 1855 to date.

Learning Outcomes:

1. Knowledge & Understanding:

By the end of the study-unit the student will be able to:

- identify the main sources of the Maltese Criminal Code;
- discuss the various versions that lead to the drafting and subsequent approval of the Criminal Code;
- trace the influence that reports had in the eventual development of the Criminal Code.

2. Skills:

By the end of the study-unit the student will be able to:

- write about the historical development of the Criminal Code;
- contextualise the development over time of the provisions of the Criminal Code;
- compare and contrast the various versions of the provisions of the Criminal Code as they evolved over time.
