DESCRIPTION | This study-unit enables students to get an overview of the relevant legislation related to Health and Safety in the Maltese context. More specifically, the unit introduces the Maltese and European legal system and provides a background to the development of health and safety law. The unit then focuses on the Health and Safety Act along with important legal notices pertaining to: construction; work equipment; quarries; general provisions; workplace regulations and; minimum health and safety requirements. Relevant case law is used throughout the unit to provide context and focus on specific aspects of the law. Study-Unit Aims: The main aim of this study-unit is to provide students with an understanding of the Maltese legal system and a background of the main Health and Safety laws in the Maltese context. Learning Outcomes: 1. Knowledge & Understanding: By the end of the study-unit the student will be able to: - State the meaning of common terms used in legal documents; - Describe the set-up of the Maltese and European legal system; - State the history and development of international and local OHS legislation during a final assessment; - Evaluate the impact of regulation and legislation at the place of work during a final assessment; - Describe and analyse the contents of The Occupational Health and Safety Act XXVII/2000 during a final assessment; - Describe and evaluate the contents of the following legal notices pertaining to health and safety during a final assessment: L.N. 281 of 2004 Work Place (Minimum Health and Safety Requirements for Work at Construction Sites) Regulations [S.L. 424.29]; L.N. 282 of 2004. Work Equipment (Minimum Health and Safety Requirements) Regulations [S.L. 424.30]; L.N. 379 of 2003. Protection of Workers in the Mineral Extracting Industries through Drilling and Workers in Surface and Underground Mineral Extracting Industries Regulations [S.L.424.26]; L.N. 36 of 2003. General Provisions for Health and Safety at Work Places Regulations [S.L.424.18]; L.N. 45 of 2002. Work Place (Provision of Health and, or Safety Signs) Regulations [S.L.424.16]; and L.N. 121 of 2003. Minimum Requirements for the Use of Personal Protective Equipment at Work Regulations [S.L.424.21]. 2. Skills: By the end of the study-unit the student will be able to: - Interpret and communicate legal liability to managers, employers and contractors; - Utilise understanding of law within daily OHS practice; - Provide statutory evidence to defend or support an OHS preventive action; - Act in court as a witness or expert witness.
