DESCRIPTION | The study-unit exposes law students to Malta's legal and regulatory framework pertaining to the relations of employee representatives (trade unions) and employers, in the Maltese industrial relations. Title 2 (industrial relations) of the Employment and Industrial Relations Act (Cap 452, Laws of Malta) is examined in detail and subsequently students are familiarised with various practical legal aspects of industrial relations, namely recognition for collective bargaining, collective agreements, trade disputes, dispute settlement mechanisms, and industrial action. Ultimately the notion of social dialogue is introduced, whereby social partners interact in areas of national policy beyond industrial relations. Study-Unit Aims: The aims of the study-unit are to enable students to study in depth: the provisions of Title 2 of the Employment and Industrial Relations Act (Cap 452) in relation to industrial relations; the practical legal aspects of industrial relations, namely: recognition for collective bargaining, the collective agreement, trade disputes, dispute settlement mechanisms, and industrial action. The notion of social dialogue in a local and European context and the important functions of social partners and industrial relations actors are also studied. Learning Outcomes: 1. Knowledge & Understanding: By the end of the study-unit the student will be able to: - apply the law regulating industrial relations and its regulatory framework; - critically evaluate the objectives and essential elements of industrial relations regulation and its application in ensuring industrial peace; - compare and contrast the roles and functions of trade unions and employers in industrial relations and society. 2. Skills: By the end of the study-unit the student will be able to: - guide ones self and others with regards to industrial relations regulation in Malta; - keep up to date with the evolving industrial relations framework; - apply industrial relations legislation in practical situations as a practitioner; - critically examine practical situations in industrial relations, particularly in the context of trade disputes.
