Study-Unit Description

CODE PLC5640

TITLE Practicum in Procedural Law

UM LEVEL 05 - Postgraduate Modular Diploma or Degree Course

MQF LEVEL 7

ECTS CREDITS 5

DEPARTMENT Pastoral Theology, Liturgy and Canon Law

DESCRIPTION The study-unit consists of a practicum and involves taught sessions and an academic research exercise on the application of judicial procedures in an actual tribunal setting. It follows a combination of learning experiences through fact-finding, observation, reflection and application of previously or concurrently studied theory. The students will be given a set of guidelines to follow in their practicum, in what to observe, what kind of questions to ask, and how to assess the practical application of procedures.

Study-Unit Aims:

The study-unit aims to familiarise students with canonical procedural law and help them acquire a realistic perspective regarding its practical application in a particular ecclesiastical tribunal. It intends to help students to make links between theory, research and practice in a reflexive manner and to refine the knowledge and skills they develop throughout the course by observing and assessing actual tribunal work. The practicum also presents students with the opportunity to gain a hands-on experience and collaborate with professionals outside the University, under the supervision of an academic tutor.

Learning Outcomes:

1. Knowledge & Understanding:

By the end of the study-unit the student will be able to:

- compare the theoretical and practical elements of procedural law;
- distinguish between different judicial proceedings;
- analyse the various steps of a canonical process;
- evaluate the roles of the various persons involved in tribunal procedures.

2. Skills:

By the end of the study-unit the student will be able to:

- review the strengths and limitations of the judicial process;
- formulate a list of good practices in tribunal procedure;
- apply procedural canon law to different cases;
- gather, assess, and interpret evidence during a process.
